Hon. Justice Philip Nyamu Waki

The Hon. Mr. Justice Philip Nyamu Waki (Justice Waki) has had a distinguished career in the Kenyan legal and judicial systems spanning over three decades, leading to hisappointment as a Judge of the Court of Appeal, the highest court in the land, in June 2003. He is still serving in that capacity.

Justice Waki holds a Bachelor of Laws, Honours, degree from the University of Nairobi (1974) and a diploma from theKenya School of Law (1975). His career as a Legal Practitioner was firmly established as an Advocate of theHigh Court of Kenya for a period of 20 years before hisappointment as a Judge of the High Court in 1995.

Justice Waki is widely traveled and has attended and presented papers at numerous professional conferences, seminars and workshops in Kenya and abroad between 1986 and 2008. These include: "International Humanitarian Law" (Law of Armed Conflict); Training as a trainer on "Human rights law pertaining to women" (Jurisprudence of equality); "Domestic Application of International Human Rights Law"; "International Protection and Refugee Law"; "Sustainable Development and the Rule of Law".

In his career, he has been an active member of the Law Society of Kenya (LSK), The Kenya Magistrates & Judges Association (KMJA), the East African Magistrates & Judges Association (EAMJA); the Commonwealth Magistrates & Judges Association (CMJA) and theChartered Institute of Arbitrators (CIArb) - among other societies. He is currently a member of the Rules Committee and the Expeditious Disposal of Cases Committee, both Committees of the Judiciary spearheading major procedural and systemic reforms in the Judiciary for effective and efficient delivery of justice. He is also the Chairman of the Technical Coordination Committee of the national initiative addressing reforms in the key sectors of Governance, Justice, Law and Order (GJLOS).

Justice Philip Waki was born in Machakos District in Kenya in 1949. He is married with seven children, three of them adopted orphans. He has one grandson.

Justice Philip Waki, chair of the Commission of Inquiryinto Post-Election Violence said the commission will not issue an order to stop the amnesty debate, saying it was early for the commission to address the issue. He added that Police Commissioner Hussein Ali and heads of the National Security Intelligence Service, Prisons, Administration Police and the Military would be investigated for their role in the violence. Healso said that suspects currently in the police custody would also give evidence.

Justice Waki joined the Special Court in 2012 as an Alternate Appeals Judge for the Taylor appeal. Before joining the Special Court, Justice Waki served as a judge of theKenya Court of Appeal in 2003, after having been a Judge of the High Court of Kenya for nine years.

Justice Waki has worked actively for reform within the Kenyan judiciary.

In 2008 he was named Chairman of the Commission of Inquiry into the Post-Election Violence in Kenya, also called the "Waki Commission," to look into the political violence committed during Kenya's 2007 elections.

In 2008 the International Commission of Jurists (Kenya) conferred the "Jurist of the Year Award" upon Justice Waki.He has served as Vice President of the East African Judges and Magistrates Association, and in 2012 was appointed by the Director of UNEP as a member of the International Advisory Council on Environmental Justice.

Justice Waki was awarded the Jurist of the Year award for 2008. He qualified from the University of Nairobi with Bachelor of Laws Degree in 1974 before admission to the Roll of Advocates in 1975. For twenty years thereafter, hepracticed law privately in all Kenyan courts until hisappointment as a Puisne Judge of the High court of Kenya in October 1995. After nine years, in June 2004, he was promoted to the Court of Appeal where he sits currently. He is also a member of the Chartered Institute of Arbitrators (Kenya). He has also been appointed as an alternate judge for the Appeals Chamber of the Special Court for Sierra Leone.
